<p>The theory of class struggle lay at the root Marxist methodology. According to historical materialism, slave formation existed in ancient Roman state, and historians further developed concept divisions society. Their views on this subject permeated also research law, which was be studied terms influence that struggles had evolution state legal norms Rome. This approach mainly concerned private primary interest scholars. The author attempts determine whether issue constituted a reference point for studying criminal law Rome, character public norms. article examines most representative scholars who applied method their research. Despite attempts, they found it hard uphold society been divided into antagonistic structurally homogeneous classes, what is more, these classes united by consciousness.
